EEOC sues Vitol and Johnson Controls for retaliation

The Equal Employment Opportunity Commission has filed a lawsuit against Houston-based companies Vitol, Inc. and Johnson Controls, Inc. for allegedly retaliating against a woman who filed a charge of discrimination with the EEOC.

After being fired by Vitol in 2008, Lucinda Gonzalez filed a discrimination complaint with the EEOC. In the meantime, Gonzalez began working for Johnson Controls.

According to the EEOC, Vitol forwarded a copy of the discrimination charge to Johnson Controls allegedly in retaliation for Gonzalez’s filing the complaint. Johnson Controls then fired Gonzalez shortly after receiving the charge from Vitol.

R.J. Ruff, Jr., district director of the EEOC’s Houston District Office, said, “Even if a charge, made in good faith, is dismissed, an employee must be protected from adverse action for filing the charge.”

State of the Congressional Workplace shows increase in workplace harassment complaints

The Office of Compliance, which monitors congressional workplace issues, released its annual “State of the Congressional Workplace” report today. The annual report provides information about the Congressional workplace, including statistical information about the use of the Office of Compliance by Congressional Members, employing offices, and Congressional employees.

This year’s report shows an increase in the number of congressional staffers who have filed workplace harassment, discrimination, and retaliation complaints. There were 168 discrimination and/or harassment claims and 69 retaliation claims filed by Congressional employees in 2010.

Tamara Chrisler, the executive director of the Office of Compliance, said, “The OOC has felt the impact of a substantial increase in discrimination, harassment, and retaliation cases over the past 5 fiscal years. The OOC dispute resolution program in fiscal year 2010 saw an increase in formal requests for confidential counseling and mediations, compared to five fiscal years ago.”

Jesse Jackson accused of gay sexual harassment by former employee

Tommy Bennett, an openly gay former employee at the Rev. Jesse Jackson’s Rainbow PUSH Coalition, has filed a sexual harassment, discrimination, and wrongful termination lawsuit against the organization.

Bennett, the former National Director of Community Affairs, claims that Jesse Jackson propositioned him for oral sex and asked Bennett to apply cream to “a rash between his legs.”

According to the Windy City Times, “Bennett also claims that he had to escort women to Jackson’s room and ‘clean up his room after sexual intercourse with women. Mr. Bennett believes he was forced to do these tasks due to his sexual orientation.’”

Glendale Police Department suspends officers following hostile work environment allegations

The Glendale Police Department, which has been the subject of multiple discrimination lawsuits in the past year, has placed a number of its officers on administrative leave following a number of problematic incidents.

According to the Los Angeles Times, “One [of the incidents] involves alleged sexual solicitation and the other involves allegations that an officer created a hostile work environment by pushing a colleague to join a lawsuit against the department.”

Yosemite National Park’s The Redwoods pays $165,000 to settle EEOC discrimination lawsuit

Wawona Property Management Inc., doing business as The Redwoods, has agreed to pay $165,000 to five former Latino employees who claim they were discriminated against and harassed by a manager who preferred non-Latino workers.

The EEOC lawsuit, which was filed last year, also alleges that Pamela Cornwell, the general manager at The Redwoods, was fired after she reported the harassment to the company’s board of directors.

Rick Stephens, the president of Wawona’s board of directors, said in a statement that the company decided to settle the case to avoid an expensive lawsuit. Stephens said that The Redwoods investigated and found that no harassment or discrimination had occurred.

Seaside Park Police Dept weight discrimination lawsuit dismissed

A judge has dismissed the weight discrimination lawsuit that was filed against the Seaside Park Police Department.

A complaint from a former borough police sergeant who sued the borough, primarily claiming he was harassed because of his weight, has been dismissed.

James C. Citta, who filed the lawsuit in February 2009 against the police department and former Police Chief William Beining, claimed that he was subjected to harassment and a hostile work environment because he was considered too fat.
