Court dismisses employee’s hostile work environment lawsuit after his lawyer misses deadline

A Tennessee District Court dismissed a racial harassment and retaliation lawsuit because the employee’s lawyer, Andy Allman, missed the deadline to file the lawsuit by three days.

The judge, Aleta Trauger, said that the court would not make an exception in this case because it would then have to make exceptions “in every case where sloppy procedures in a lawyer’s office caused a client to miss the statute of limitations.”

Allman’s client, Frederick Lisenbee, claims that he was fired from his job at Clarksville Gas & Water in retaliation for complaining about a racially hostile work environment.

The court’s decision to dismiss Lisenbee’s case did not address his racial harassment claims.
