Judge overturns $700,000 jury decision in Miami Beach sexual harassment lawsuit

U.S. District Judge Marcia Cooke has overturned a jury decision that had awarded $700,000 to a Miami Beach firefighter who claimed that she had been subjected to sexual harassment.

Marlenis Smart claimed in her lawsuit that her bosses and coworkers created a sexually hostile work environment over a long period of time and subjected her to personal attacks and even death threats.

Judge Cooke decided that the incidents that Smart complained about, though “inappropriate, vulgar, and offensive,” were not severe or pervasive enough to meet the legal definition of sexual harassment.

Smith is appealing Judge Cooke’s decision.
