Marchuk claims that Monteverde subjected her to a sexually hostile work environment that included “a barrage of improper, explicit, and unwanted sexual advances.”
Marchuk alleges that she complained to another Faruqi & Faruqi partner about Monteverde’s alleged sexual harassment. According to the complaint, after she complained about the hostile work environment, “Marchuk’s situation got worse, not better.”
Monteverde allegedly retaliated against Marchuk for complaining about his behavior “by publicly and baselessly demeaning her legal abilities and threatening to terminate her employment – all while continuing improperly to promosition Ms. Marchuk.”
Then, during a Faruqi & Faruqi holiday party the evening of December 15, 2011, Monteverde allegedly “coerced and threatened her that if she did not have sex with him he could not recommend her for a year-end bonus and likely would terminate her emloyment at F&F. Thus Mr. Monteverde induced Ms. Marchuk to go back to F&F’s offices with him where he quickly and forcefully had sex with her.”
Marchuk resigned from Faruqi & Faruqi shortly thereafter.
Lubna Faruqi, managing partner of Faruqi & Faruqi, said in a statement: “These claims are completely without merit brought by a disgruntled former employee. We look forward to aggressively defending our reputation in court and have every confidence we will be vindicated.”
