City of Huntsville discrimination lawsuit dismissed by judge

U.S. District Judge Abdul Kallon has dismissed a discrimination and retaliation lawsuit that was filed against the City of Huntsville by former employee Susan Weber.

Kallon ruled that there was no evidence that Weber was subjected to gender, age, or disability discrimination, nor did the judge believe that Weber was retaliated against by her boss, Joy McKee, for filing a discrimination claim with the EEOC in October 2010.

Weber claims that her being transferred from her position as manager of Hays Nature Preserve and Goldsmith-Schiffman Wildlife Sanctuary to a grant-writing position in 2008 amounted to discrimination. Weber was eventually fired in November 2012 for insubordination.

The judge, however, found that Weber was moved to the grant-writing position becuase of city budgetary contraints, complaints about Weber’s job performance, and several negative write-ups in her personnel file.
