Sutter Transfer Service, a trucking company based in Yuba City, California, and Fiveway LLC have agreed to pay $30,000 to two of its employees to settle an EEOC racial harassment lawsuit.
Lonnie Winstead claims that his dispatcher subjected him to racial harassment by calling him derogatory slurs such as “gorilla,” “porch monkey,” and the N-word.
According to the EEOC, one of Winstead’s white coworkers complained to company management about the harassment, but the companies did not take sufficient action to stop the harassment.
EEOC San Francisco Regional Attorney William R. Tamayo said, “All employees have the right to work in an environment free from hostility, intimidation, and ridicule. In this case, the companies failed to live up to their responsibility to provide a workplace free of racial hostility.”
