CSX Corp $2 million hostile work environment lawsuit

West Virginia’s Supreme Court has upheld a $2 million judgment that had been awarded against CSX Corp. in a hostile work environment lawsuit.

A jury had found that trainmaster Angela Smith was wrongly fired by the railroad company in retaliation after reporting sexually offensive comments by a coworker named E. Wesley Knick.

Smith filed a complaint after allegedly being subjected to sexual harassment, a hostile work environment, constructive discharge, and retaliation for her complaints of sexual harassment.

West Virginia attorneys Mark A. Atkinson and Paul L. Frampton, Jr. from the law firm Atkinson & Polak, PLLC and Harry M. Hatfield represented Smith in the lawsuit against CSX Corp.
