EEOC sues Bauermeister for disability discrimination

The Equal Employment Opportunity Commission has filed a disability discrimination lawsuit against German-based Probat, Inc., doing business as Bauermeister, Inc.

According to the EEOC, Bauermeister fired an employee at its Memphis, Tennessee facility after he informed the company president that he suffered from a disability, bipolar disorder.

“The ADA, as amended by the Americans With Disabilities Act Amendments Act, prohibits employers from taking actions based on assumptions about how a disability will affect an employee’s ability to perform the job,” said Katharine W. Kores, district director of the EEOC’s Memphis District Office.
