Utah boss arrested for child pornography and sued for sexual harassment

Former Sabol and Rice, Inc. employees Kristall Butters and Franki Chipman filed a sexual harassment lawsuit against the Salt Lake City company and it’s owner, David Christopher Robertson.

In December 2009, Butters filed a complaint with the Equal Employment Opportunity Commission and received a ‘right to sue’ notice in July 2010.

Both Butters and Chipman claim that Robertson often viewed adult and child pornography in his office and because he did not always hide what he was viewing, they were subjected to a sexually hostile work environment.

According to the complaint, in early spring 2009, three female employees at Sabol decided to report Robertson’s offensive and illegal conduct to the Internet Crimes Against Children Task Force (“ICAC”). 

As a result, in May 2009, Robertson was arrested by federal marshalls at the office for possessing and viewing child pornography, and his office computer was confiscated by law enforcement officers.

Upon Robertson’s return to work, he informed receptionist Naomi Hatch that as soon as he discovered who had reported his sexual activities to the authorities, he would immediately terminate that person’s employment.

Butters and Chipman allege that Robertson continued to view adult and child pornography in view of his female employees and was arrested again in September of 2009, for possessing and viewing child pornography.

On September 16, 2010, Robertson was indicted on federal charges of Possession of Child Pornography.  On April 19, 2010, Robertson pled guilty to Count I of the indictment, Possession of Child Pornography.  On November 15, 2010, Robertson is scheduled to be sentenced in federal district court on the aforementioned federal crimes.

Franki Chipman claims that in December 2008, credit manager Bart McDonald sexually assaulted her by grabbing her breasts when she passed his office.  Chipman immediately reported this incident to her immediate supervisor, Greg Hood, who responded by telling Chipman that he had “thought of doing that myself but did not know if I’d get slapped or graded.”

Even though Chipman tried to avoid McDonald, she claims that two weeks after the first assault, McDonald again sexually assaulted Ms. Chipman by grabbing her buttocks and telling her that “her butt looks great in those jeans.”

Chipman again reported McDonald’s sexual assault to Hood, whose response was allegedly that McDonald was “harmless” and “probably can’t get it up.”

In April 2009, Chipman took medical leave for one week due to a pinched nerve related to the stress of the hostile work environment and sexual harassment.  While on medical leave, Chipman claims that Hood sent several sexually explicit text messages and instant messages to Chipman’s daughter from Chipman’s computer.

Chipman was fired on July 23, 2009, and Butters was terminated on August 28, 2009.
