Former Lake Wales police Sgt. Burney Hayes, who was fired on September 22, filed an appeal with the city on October 4.
A city investigation had found that Hayes violated police department regulations in May 2010 when he left his shift and went home without requesting permission or telling dispatchers.
Hayes has been the subject of other disciplinary matters and offenses.
According to the News Chief, In May 2009. while Hayes was volunteering as a coach at a Lake Wales High School junior varsity football game, he allegedly bit a 15-year-old player’s nose. Prosecutors charged him with battery, but the case went into a pretrial diversion program that required Hayes to complete an anger-management program.
Hayes was the subject of a sexual harassment complaint by the police chief’s secretary. After investigating the complaint, Human Resources Director Sandra Davis decided that Hayes’ behavior constituted horseplay and not sexual harassment. Hayes was suspended for one week in June 2009 for this incident.
